This area has been the subject of much misreporting because the Taliban in this instance is more likely to be a self-justifying health and safety official from the local council than a hard-pressed employee of the Health and Safety Executive."


The Health and Safety at Work Act has saved thousands of lives, largely due to sensible application of its principles by Health and Safety Executive Inspectors and by health and safety professionals in industry. I would not like that progress to be lost due to unfounded criticism by journalists or ill-informed decisions by people, in both the private and public sectors, who try to disguise economy measures under the banner of health and safety.

British health and safety law has always been based on the premise that not all risk can be eliminated and some low level risk is tolerable, a view recently upheld by the European courts.

MRSA claims not easy to prove in court - Health News - News - icWales: "Nov 12 2007 by Our Correspondent, Western Mail HEALTHCARE-associated infections (HAIs) are rarely out of the news these days. The best known is MRSA, while Clostridium Difficile (C.diff) has also become more prominent of late."

More recently, some attempts have been made to use the Control of Substances Hazardous to Health (COSHH) regulations as the basis for HAI claims.

Using a little lateral thinking, some lawyers have argued that bacteria such as MRSA or C.diff fall within the definition of “a substance hazardous to health”. This being the case, the COSHH regulatory obligations would apply to hospitals in their treatment of patients.

But a case last year suggested that relying on those regulations will not necessarily make these claims much easier to demonstrate, at least in the short term.

Until there is a full-blown trial that decides whether the COSHH regulations truly apply, this will remain a grey area.

80 / 20 Rule

The 80/20 Rule is also known as "Pareto's Principle." Vilfredo Pareto, a 19th century economist, found that 80% of production volume generally comes from only 20% of the producers.

The original observation was in connection with income and wealth. Pareto noticed that 80% of Italy's wealth was owned by 20% of the population. He then carried out surveys on a variety of other countries and found to his surprise that a similar distribution applied.

It also applies to a variety of more mundane matters: we wear our 20% most favoured clothes about 80% of the time, we spend 80% of the time with 20% of our acquaintances etc.

So does that mean to the safety of the workforce - are they safe 20% of the time or 80%?
or
are they in fact working unsafely 80% of the time and working safely 20%?????????

Health&Safety is out of control.Over 30 years in the construction industry has shown me that.It's a hugh organization now and if they are not continually dreaming up ever more fanciful rules for our "safety" then a lot of them are out of work.Some of the rules pertaining to safety are truly unbelievable.So indeed "spot on Boris".
